now for the boring but important bit. we’re an easy-going kind of company but in this day and age, we do need to give you the heads up on some legal stuff. by choosing to shop with TREE, you accept the Terms and Conditions below and agree to be bound by them, and an agreement is formed between you and us.
once you’ve made full payment, the legal and beneficial title of ownership of the TREE items that you purchase (the “Pieces”) will pass to you. any risk (such as loss, damage, destruction or deterioration of the Pieces) however it arises will pass to you together with the legal and beneficial title.
your Pieces will be delivered to you within fourteen days from the date of purchase, unless (i) you request otherwise via your online wishlist, via email to email@example.com or (ii) your Pieces are pre-orders (“Pre-Ordered Pieces”), in which case they will be delivered to you (“Pre-Order Delivery”) within the time period specified on your invoice or within such other time period as may be informed to you by us (the “Stipulated Time Period”).
this may sound obvious, but please do check that your Piece(s) will fit perfectly into your home. doorways, lifts and even stairwells can be deceptive. if you would like to double check the measurements to be sure, please just let us know. we can then easily arrange delivery to you.
we do not pad our furniture prices by factoring in the delivery cost. there is only one charge per delivery regardless of the number of pieces we deliver:
our delivery team can also carry your Pieces up your stairs if need be – we will just need to add a surcharge of HK$50 per man, per flight of stairs – this is market practice and goes direct to the guys that do the hard work, not to us.
payment for delivery and all relevant surcharges (according to the charges as listed above) should be settled prior to, or at the time of, delivery of your Pieces.
if you would like us to (i) in the case of Pieces from our stock, deliver the Pieces to you on a date which is later than fourteen days from the date of purchase, or (ii) in the case of Pre-Ordered Pieces, deliver the Pre-Ordered Pieces on a date which is later than the Stipulated Time Period (“Deferred Delivery”), please email us at firstname.lastname@example.org, referencing clearly the delivery date.
if you have opted for Deferred Delivery or if you have purchased Pre-Ordered Pieces, we will, during the period from the date of purchase for the Pieces up until the time of Deferred Delivery or the time of Pre-Order Delivery, as the case may be (the “Period”): (a) hold the Pieces as your bailee and (b) store the Pieces separately and in an safe and secure place, clearly showing your legal and beneficial ownership of the Pieces and ensuring that they are clearly identifiable as your Pieces.
during the Period, we also reserve the right to, at any time, appoint any third party as your sub-bailee to hold the Pieces and store the Pieces in accordance with the above condition (b).
in the event of Deferred Delivery, in addition to the delivery charges listed in the previous section titled “Delivery”, we will also need you to cover all storage costs for the Pieces during the Period. we will, of course, provide quotations for these costs in advance for your reference and approval. all delivery charges and storage costs must be settled at the time of your request for storage and at the time of any storage period extension.
we strive to make sure that our furniture reaches its new home as soon as possible. but as there are many factors involved in the delivery process, any times quoted for delivery are genuine estimates only and are given in good faith, but are not guaranteed. because of this, please understand that we are unable to accept any liability if there is any delay in delivery.
Return of Goods
all sold items are non-refundable.
if for any reason you are not happy with your purchase(s), please notify us in writing within seven days of delivery for an exchange or credit note valid for one year. we will arrange collection and you will be charged for the costs and expenses of returning the piece(s), which must be paid prior to the collection.
naturally, we cannot accept returns of custom made, commissioned or bespoke pieces, damaged pieces, TREE gift vouchers, home ware, art, plants, unwrapped mattresses, bed linens, cushions or rugs. sale or discounted items, one off items and any items damaged after you have acknowledged receipt are also not eligible for exchange.
THE LEGAL BIT
a few final legals which are dull but essential. namely, that we shall not, except in respect of death or personal injury caused by our negligence, be liable to you by reason of any representation or implied warranty, condition or other term or any duty at common law, or under the Terms and Conditions, for any indirect, special or consequential loss or damage (whether for loss of profit or otherwise) costs, expenses or other claims for compensation whatsoever (whether occasioned by negligence of ours or our employees or agents or otherwise) arising out of or in connection with any act or omission of ours relating to the supply of the Pieces, their use or resale by you or their use by any customer, and our entire liability hereunder shall not exceed the price of the Pieces.
THE FINAL WORD
these Terms and Conditions are written in English but we do also have versions in both Traditional and Simplified Chinese which are available upon request by emailing email@example.com. if there is any conflict or inconsistency between translations, please note that the English version shall be the governing and prevailing version.
